The Ministry of Labour states that FGTS arising from labour claims with judgments from 1 May 2026 must be collected through FGTS Digital. Claims with judgments up to 30 April 2026 remain on the SEFIP/GFIP 660 route.

Our recommendation is to make the judgment date and applicable payment route explicit in the handover from legal counsel to payroll. The case file should identify the worker, relevant periods, calculation basis, supporting decision and payment responsibility.

Before settlement, reconcile the legal calculation with the information prepared for reporting and the resulting payment guide. Assign one person to resolve differences between legal, payroll and treasury records.

After payment, retain the guide, bank confirmation and reconciliation with the case file. This creates a traceable record for internal review and subsequent questions about the liability.
