The Ministry of Labour and Employment published guidance on assessing people with type 1 diabetes or Tourette syndrome for Brazil’s statutory quota for people with disabilities and rehabilitated beneficiaries.
The guidance does not create automatic inclusion based on a diagnosis. For inspection purposes, a diagnosis or ICD code alone is insufficient. The evidence must permit an individual assessment of long-term impairment, limitations in performing activities and restrictions on participation, applying the relevant biopsychosocial criteria.
Review the evidence, not only the label
Employers subject to the quota should verify whether the supporting reports address the required functional and participation elements. A diagnosis-only record should not be treated as conclusive. At the same time, the guidance does not justify automatic exclusion: each case still requires an individual assessment.
Ewaider recommends keeping the quota analysis and its supporting evidence controlled, current and separated from broader medical records. HR and legal teams should align the assessment process before changing how an employee is counted. These are process recommendations; the Ministry’s announcement standardises inspection analysis rather than replacing professional evaluation.
